Terms and conditions

Article 1 (Purpose)
The purpose of these terms and conditions is to set forth the terms and conditions under which ABYSS COMPANY Co., Ltd. (hereinafter, referred to as “Company”) provides the audition service through a given procedure and stipulate other requirements.

Article 2 (Effect of Terms and Conditions)
1. These terms and conditions become effective as they are presented on the service screen or notified to the Applicant through e-mail or other possible methods in accordance with Article 32 of the Telecommunications Business Act.
2. The Company may change these terms and conditions, and the revised terms and conditions will become effective as they are announced or notified.

Article 3 (Other Related Laws and Regulations)
Facts which are not mentioned in the terms and conditions hereunder shall follow the Framework Act on Telecommunications and other related laws.

Article 4 (Definitions)
Definitions of terms used in the terms and conditions are as follows.
1. Applicant: Customer who apply for auditions hosted and serviced by the company
2. Service: Auditions hosted by Abyss Company (audition.abysscompany.com)

Article 5 (Application Procedure for audition)
1. Audition application is made by filling up the online application form.
2. The Company approves the application when the applicant applies for audition by accurately providing the required information on the application form in Paragraph 1. However, the Company may defer its approval of the application in each of the following cases.
a. Technical difficulties in approving the application;
b. If the applicant used unreal name or another person’s name;
c. If the applicant provided false information for the required information when signing up for audition;
d. If the applicant does not satisfy the conditions for application set forth by the Company;
e. If the Company has sufficient reasons to defer the approval of the application.

Article 6 (Contents of Service)
The Company provides the Applicant using overall facilities of the Company with services including auditions, and details of the service will be posted separately on the homepage.

Article 7 (Obligations of Company)
The Company does not disclose the personal information of the Applicant obtained in relation to the services provided to the third party without the Applicant’s consent. However, this does not apply if requested by a national agency in accordance with the provisions under related laws such as the Telecommunications Business Act, if required by criminal investigation, if requested by Korea Internet Safety Commission, or if requested through due process of related laws.

Article 8 (Obligations of Member)
1. The Applicant shall observe matters notified by the Company such as related laws, provisions under these terms and conditions, user guide, and cautions and shall not engage in any act that disturbs the Company’s operation.
2. The Applicant shall not use the information obtained through the use of Company’s services in the form of copying, reproducing, modifying, translating, publishing, or broadcasting the information or other ways or provide it to the third party without prior consent of the Company.
3. The Applicant shall not engage in any of the following activity in relation to the use of Company’s service.
a. Any act that harms good custom or other social order
b. Any act intended for a criminal act or other acts related with a criminal act
c. Any act of infringing another person’s rights such as intellectual property
d. Any act that disturbs or possibly disturb stable operation of the services
e. Any act breaching other related laws

Article 9 (Provision of Information and Posting of Advertisement)
1. The Company may provide its Applicant with a variety of information by posting it on the website or by other means in operating its services.
2. The Company may post advertisement and so forth through website, e-mail, and SMS in relation to the operation of its services.

Article 10 (Commissioning of the Management of the Personal Information)
In principle, the Company shall handle and manage the collected personal information. However, if necessary, such can be commissioned to subcontractors in whole or in part, and the details of the subcontractors can be found in the ‘Privacy Policy’ section of the Company service homepage.

Article 11 (Suspension of Service Provision)
The Company may suspend the service provision in one of the following cases.
1. If it is inevitable for the repair and maintenance of service;
2. If the key telecommunications service operator specified in the Telecommunications Business Act suspends the telecommunications services; and
3. If there are reasons for which the Company cannot provide the service.

Article 12 (Limitation on Liabilities)
1. The Company is exempted from the responsibilities to provide services if it is unable to provide them due to natural disasters or other uncontrollable events.
2. The Company shall not be held responsible for the troubles in using services attributed to the Applicant’s fault.
3. The Company shall not be held responsible for the use of services provided for free unless otherwise specified by special clauses under related laws.

Addendum
1. These terms and conditions are effective from March 8, 2021.

Privacy Policy *Required

ABYSS COMPANY Co., Ltd. (hereinafter, referred to as “Company”) values the personal information of the audition applicants (hereinafter, referred to as “Applicant”) and abides by the Personal Information Protection Act and the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc.

The Company will inform the Applicant of the purpose for which the personal information he or she provided is used, how it is used, and what measures have been taken to protect the personal information. The Company will notify you of any revision of the privacy policy through the website announcement (or individual announcement).

This Policy will become effective on March 08, 2021.

Article 1. Personal Information Collected
The Company is collecting following personal information for the submission of audition application, the selection of successful candidates.
- name, nationality, gender, e-mail address, mobile phone number, and any photograph, music or sound, video and other work uploaded by Applicant
- Personal identification information of the legal representative of the Applicant under 14-years-old: Name, contact information, e-mail address
- Automatically generated/collected information when applying for audition: Record of use (time of use), connection IP information, cookie, etc.

Article 2. Purpose of Collecting and Using Personal Information
Company uses the personal information collected for following purposes;
- To decide, notify, and announce the successful candidates of the audition and to use it in relation to training;
- To announce the audition;
- For personal identification of the legal representative of the Applicant under 14-years-old;

Article 3. Period of Retaining and Using Personal Information Collected
In principle, the Company immediately destroys the personal information after the purpose of collecting and using the information is achieved. Notwithstanding the foregoing, if the period of retention and use of personal information that the Applicant has consented to has not expired and in following cases, however, the Company will retain the personal information for the period as prescribed under applicable laws and regulations if any personal information is required to be retained under such applicable laws and regulations;
- Personal information required to be retained under Company’s internal policy: 3 years (to prevent illegal or unauthorized use, notified when the audition is held)
- Records relating to website visits such as access log: 3 months (Protection of Communications Secrets Act)

Article 4. Procedures and Methods for Destruction of Personal Information
In principle, the Company immediately destroys the personal information after the purpose of collecting and using the information is achieved. The destruction procedures and methods are as follows;
- Destruction Procedure
The information that the Applicant provided to apply for the audition is transferred to a separate database (DB) (separate document box for paper) after the purpose of such information is fulfilled, stored for a fixed period of time based on the Company’s policy and the reason for information protection pursuant to related laws (refer to Period of Retention and Use of Personal Information), and destroyed. The personal information transferred to a separate DB is only retained and not used for other purposes unless otherwise required by law
- Destruction Method
The personal information saved in an electronic form is deleted in a technical method which disables the regeneration of the records. The personal information printed out on the paper is shredded by shredder or burned to destroy.

Article 5. Provision of Personal Information
The Company will not provide the Applicant’s personal information to third parties except the following cases;
- The Applicant has consented to the provision in advance;
- It is required by the provisions under related laws.

Currently, the Company is not providing the Applicant’s personal information to a third party and will go through legitimate procedures as set forth in the relevant laws and regulations.

Article 6. Consignment of Personal Information Collected
The Company consigns the processing of the personal information to a professional agency outside the Company as in the following in order to provide more professional services. The Company is taking all necessary measures pursuant to related laws and regulations so that the Applicant’s personal information is managed securely.
- Consignee: 2b / Audition page management, maintenance and repair

Article 7. Rights of Applicant and Legal Representative and Method of Exercising Rights Thereof
- The Applicant or the legal representative may inquire or modify his or her own information or the information of the child under 14 years of age her or she represents at any time or also request for correction.
- For the inquiry and correction of the personal information of the Applicant or the child less than 14 years of age, contact our Personal Information Protection Manager in writing, via telephone or e-mail for immediate action.
- In the event that the Applicant requests for the correction of the errors in the personal information, the personal information will not be used or provided until the correction is completed. Also, in the event that incorrect personal information has already been provided to a third party, the Company will immediately notify the third party of the result of correction to rectify any error.
- The personal information deleted upon the request made by the Application or his or her legal representative will be handled as specified in the “Period of Retaining and Using Personal Information Collected” and peruse or use of the information for other purposes will be strictly prohibited.

Article 8. Installation, Operation and Refusal of Instrument for Automatic Personal Information Collection
A cookie is a very small text file that the server saved to the user’s computer through the user’s web browser from the website the user accesses. When the user revisits the website later, the website’s server reads in the information in the cookie stored in the user’s computer to maintain the environment in which the user uses the service as configured by the user to enable convenient use of the internet services. Also, the information of the service used, the time the user accessed the service and the frequency, the information generated or provided (entered) in the course of using the service may be analyzed to provide the services (including advertisements) tailored to the preference and interest of the user. The user has the right to use or disuse the cookie and may configure the options of the web browser to accept all cookies, have the browser ask whether to accept cookies each time, or block all cookies. However, refusing to install cookie may lead to difficulties in using the services.

- Ex: The Applicant may configure the options of the web browser that he or she uses to accept all cookies, have the browser ask whether to accept cookies each time, or block all cookies
- Example (Internet Explorer): Go to Tool on the top of the web browser > Internet Option > Personal Information and choose the option.
- However, refusing to install cookie may lead to difficulties in using the services.

Article 9. Technical and Administrative Safeguards against unauthorized disclosure
The Company maintain the following technical and administrative safeguards to protect against unauthorized disclosure, use, loss, alteration or destruction of the personal information you provide.
- Development and implementation of internal control system
The Company make all reasonable efforts to ensure that personal information is properly protected under the internal policy. The Company have appointed a privacy officer who will be responsible for monitoring, identifying and taking appropriate corrective actions against any unauthorized access, use or disclosure of the personal information.
- Measures against hacking
The Company use virus protection & vaccination programs to prevent any damage from computer viruses. All the protection & vaccinations are updated periodically, as well as immediate vaccination protocol upon an introduction of a new virus, to ensure the safety of you Information. The Company utilize encrypted algorism to ensure secure transmission of information for SSL network connections. The Company also use firewall and weakness analysis system to keep the personal information you provide on this Website secure from hacking and outside attack. The Company keep the personal information separate from other data using a separate server.
- Restricted Access and Training
The Company authorize only a limited number of employees (including marketing managers, privacy officers, others who need to know the information to perform their duties) to access the personal information you provide. The Company periodically conduct training for employees who handle the personal information to acquire new security technology and professional knowledge as well as compliance with this Policy.

Article 10. Complaints Relating to Personal Information
The Company has designated a department and personal information manager as follows in order to protect customer’s personal information and cope with complaints relating to personal information;

The Applicant may report any personal information related grievance that inflicted on the Applicant while using Company’s services to the Personal Information Protection Manager or the responsible department. The Company will provide a prompt and sufficient response to the reports of its Applicants.

Article 11. Notification Duty
The privacy policy was established on March 08, 202. Any addition, deletion, or modification of the contents with respect to the changes in the policy of the government and the Company will be notified immediately through the homepage, and this policy is effective as of the date it is announced.
